Entering the Contest
No entry fee or purchase is necessary to participate. By entering, you accept the below contest terms.
Prize
Details of the prize are specified below:
- One Hugo Navigator SKU 793-943 in pacific blue paint finish.
- A winner will be selected at random from all eligible entries received during the preceding calendar quarter, that begins January 1st. Drawings will take place at noon (EST) on the first Tuesday following the quarter. Calendar quarters are more precisely divided as per:
Winter: January, February, March
Spring: April, May, June
Summer: July, August, September
Fall: October, November, December
The winner will not be charged for the delivery of the prize within the continental USA or Canada, and should receive the prize within 30 days of being notified of having won. The return of any prize as undeliverable may result in disqualification and selection of an alternate winner.
Prizes are not transferable or exchangeable, and cannot be redeemed for cash.
The Winners
Past and current winners’ names can be obtained by visiting the contest winners` page. The winning name will be drawn randomly via electronic means, and will always be final.
All winners agree to take part in any promotional and publicity activity in connection with the contest at our request. In particular, you consent to your name and location being published for the purposes of the contest. In addition, we may request your photo, however this you have the right to decline.
Restrictions
By submitting an entry, you warrant that you are at least the age of majority in your state, province or territory of residence. We may require the winner to provide proof of identity and proof of age. ID considered suitable for verification is at our discretion.
No employee or representative of AMG Medical, or any member their respective families, may enter the contest unless expressly permitted. Proof of entry submission does not constitute proof of receipt.
Incomplete or corrupted entries will be disqualified. Each entry submission must be entered by the individual entrant; automated and/or repetitive electronic submission of entries will be disqualified.
Survey Intellectual Property
By entering this contest you agree that we may use your entry on our website and other social networking websites. Where applicable, you must have copyright in the materials you are submitting to us. In submitting the entry, you are agreeing and acknowledging that our use of your entry will not constitute infringement of any of your rights, including, without limitation, copyright, privacy, publicity rights, or those rights of any third party.
Where applicable, you must have permission from all individuals that appear in any material submitted (if any) to use their likeness in the material. Uploading material constitutes your consent to give us a royalty-free, irrevocable, perpetual, non-exclusive license to use and display such submissions in whole or in part, on a worldwide basis. You release us from any and all claims, liabilities, responsibilities, or damages arising from transmitting, reproducing, distributing, displaying, or publishing your entry.
We needed to include that for legal reasons, but don`t fret. What that all says is that if you send us a great picture or inspiring idea, you won`t turn around and sue us later for acting on it.
Waivers and Limitation of Liability
Expenses not specifically included in the prize description are the sole responsibility of the winner. Warranties are honored, with the date of delivery substituting for the date of purchase. If you select to receive our newsletter, you consent to your personal information being used for this purpose also.
To the maximum extent permitted by law, we assume no responsibility or liability for:
– For delays or failure to deliver the prize, insofar as this is due to the default of the winner or a third party, including but not limited to, the delivery company.
– Any incorrect or inaccurate information provided by you.
– Any damage to your own or any other computer related to an attempt to participate in the contest.
– Any unauthorized access to, or theft, destruction or alteration of entries.
We reserve the right to cancel, modify or suspend the contest in whole or in part, without further liability to you or third parties, at any time due to circumstances beyond our reasonable control, subject to the approval of the Régie des alcools des courses et des jeux in Canada. This includes, but is not limited to, the contest not being able to run through for reasons which may include computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, etc. which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest.
As a condition of entry into the contest, you agree to release us from and against any and all liability, loss, claims, demands or actions of any kind which may be sustained in connection with:
– Submitting an entry or otherwise participating in any aspect of the contest. And the receipt, ownership or use of any prize awarded.
Rules and Regulations
GENERAL PROVISIONS
Failure to comply with our terms and conditions may result in disqualification.
Except where prohibited, you agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event legal fees.
US CONTEST PROVISIONS
There may be applicable state or resident restrictions. You are responsible for complying with all applicable laws in your state of residence in connection with their participation in the Contest.
CANADIAN CONTEST PROVISIONS
Winners will be required to correctly answer a time-limited mathematical skill-testing question in order to be awarded a prize. Failure to comply with this deadline and correctly answer the skill-testing question may, at our sole discretion, result in forfeiture and selection of an alternate winner.
For the avoidance of doubt, all federal, provincial, territorial and local laws and regulations apply.
LITIGATION (FOR RESIDENTS OF QUEBEC ONLY)
Any litigation concerning the organization or how the current contest is held can be submitted to the Régie des alcools, des courses et des jeux. Similarly, any litigation concerning how prizes are awarded under the current contest can also be submitted to the Régie des alcools des courses et des jeux, for the sole purpose of regulation.
